After a parent passes away: what NRIs need to sort out in India

A practical checklist for NRIs after a parent dies in India: death certificate, legal heir or succession certificate, bank accounts, property transfer and the home.

Updated 30 October 2026

After a parent dies, most of the paperwork follows one order. Get several certified copies of the death certificate first, then a legal heir or succession certificate if there is no will. With those, you can close or transfer bank accounts and investments, update the property records in the heirs' names, and decide what happens to the home. You don't need to do it all from India.

What to do

  1. Get the death certificate from the municipal registrar, with several certified copies.
  2. Find out if there is a will. If not, apply for a legal heir certificate, and a succession certificate if banks or companies ask for one.
  3. Claim or transfer bank accounts, deposits, insurance and investments.
  4. Update property records (mutation) in the heirs' names. If one heir is giving up their share, use a relinquishment deed.
  5. Keep the home safe meanwhile: inspections, bills and keys.

Common questions

Do I need to come to India? Usually not for every step. Many steps can be done with a power of attorney and documents signed abroad.

Legal heir or succession certificate: which do I need? It depends on what you are claiming. Banks often ask for a succession certificate for larger amounts; property records often accept a legal heir certificate. We check what each office wants.
